GD EXPRESS SDN. BHD. (GDEX) with the Registration. No.: 347624-X maintains these social media accounts: Facebook page (https://www.facebook.com/GDEXOfficialPage/) and Instagram account (https://www.instagram.com/gdex_official/), and will be responsible for ‘GDEX AnakAnak Malaysia Giveaway’. Please read these terms and conditions carefully before accessing and browsing these social media accounts. You may download material displayed from these social media accounts for your non-commercial, personal use only. Additionally, you may not modify, reuse, report, or use the contents of these social media accounts for public or commercial purposes, including the text, images, audio, and video without GD Express Sdn Bhd’s written permission. GD Express Sdn Bhd reserves the right to cancel or amend the giveaway mentioned on these social media accounts or these terms and conditions at any time without prior notice. Any changes will be posted either within these social media accounts or these terms and conditions.

A. GDEX Anak-Anak Malaysia Giveaway Period

1. The giveaway is open for participation from 15 August-30 September 2022 (“Giveaway
   Period”). Late, incomplete, incorrectly submitted, delayed, illegible, corrupted, or misdirected responses will be deemed invalid. GD Express Sdn Bhd reserves the right to amend the Giveaway Period at any time without notice.

B. Eligibility

1. The giveaway is open to the public aged 18 years old and above at the time of entry in Malaysia.
2. Employees of GD Express Sdn Bhd, its related entities, their advertising and promotion agencies, and their immediate family members and/or those living in the same household are not eligible.

C. How to Enter

1. Participants may participate on Facebook, Instagram, or both platforms. Multiple entries are allowed, and all entries will be considered.

Participants will need to strictly follow the steps below:

1. Follow GD Express Sdn Bhd on Facebook (@GDEXOfficialPage) and Instagram
   (@gdex_official).
2. Like the announcement post and comment with the answer:
   1. Q: What are the local landmarks printed on the Fun Flyer?
3. Tag 3 of your friends in the comment section as well.

D. How to Win

1. Participants with the steps performed will be selected as winners randomly. All valid entries submitted between 15 August-30 September 2022 will be considered.
2. Multiple entries are allowed in accordance with the giveaway’s mechanics, however all participants can only win once (1) throughout GDEX Anak-Anak Malaysia Giveaway Period.

E. Notification of Winners

1. The winners of GDEX Anak-Anak Malaysia Giveaway will be announced on GD Express Sdn Bhd’s social media accounts: Facebook page (https://www.facebook.com/GDEXOfficialPage/) and Instagram account (https://www.instagram.com/gdex_official/) by 15 October 2022. He/she is required to acknowledge by returning a Private Message (PM) with full name, contact number, delivery address, and email address on GD Express Sdn Bhd’s Facebook page
   (https://www.facebook.com/GDEXOfficialPage/) and Instagram account
   (https://www.instagram.com/gdex_official/) before 22 October 2022. GD Express Sdn Bhd reserves the right to deal with all unclaimed prizes in any manner deemed fit.
2. Where applicable, prizes not claimed within the stated time provided via PM shall be dispose of at GD Express Sdn Bhd’s sole discretion. GD Express Sdn Bhd’s decision regarding the aware of all prizes, and/or in every situation including any not covered in these terms and conditions shall be final and binding on all participants in this giveaway, and no queries, challenges, or appeals may be made or entertained regarding GD Express Sdn Bhd’s decision on the same. The receipt by any winner of any prize under this giveaway is conditional upon compliance with any and all applicable laws, rules, and regulations.

F. Prizes

1. Subject to the terms and conditions herein, there will only be a total of six (6) winners with completed steps. Three (3) winners will be chosen from each platform (Facebook and Instagram).
2. Each winner will receive one (1) 99 Speedmart voucher worth RM100 and one (1) pack of Merdeka Fun Flyers. Prize is non-transferable.
3. The prize will be sent to the participant with the delivery address given. Delay of prize delivery might occur due to unforeseen circumstances.
4. If required, GD Express Sdn Bhd reserves the right to substitute the prizes to anything else of an equivalent value.
5. GD Express Sdn Bhd has no obligation for the second delivery if the winner fails to receive the prize. Thereafter, the winner shall assume full responsibility to contact GD Express Sdn Bhd for prize collection and liable for all costs incurred pertaining to prize collection.
6. Prizes are non-transferable and non-exchangeable for cash and may be subject to availability. GD Express Sdn Bhd reserves the right to replace any prizes with items of similar value without prior notice.
7. Acceptance of any prize shall constitute consent on the winner’s part to allow the use of the winner’s name, image, voice, and/or likeness by GD Express Sdn Bhd for editorial, advertising promotional, marketing, and/or other purposes without further compensation except where prohibited by law. Acceptance of any prize shall constitute a release and discharge of GD Express Sdn Bhd by each winner from any and all liability, claims, demands, causes of action, and/or damages which the winner may have, whether known or unknown at the present time, of and nature whatsoever, arising out of or relating to: (i) the giveaway, (ii) personal injury and/or property damage, theft or loss suffered by the winner as a result of the use and/or enjoyment of the prize, and/or (iii) any tax liabilities in relation to the giveaway, prize and/or use or enjoyment of the same.
8. By submitting the giveaway entries, each participant thereby: (a) specifically authorizes GD Express Sdn Bhd to use and/or license third parties to use such entry / images in whole or in part, throughout the universe, in perpetuity in or on any and all media, now known or here after devised, and alone or together or as part of otherwise unlawful information, infringe or violate any copyright or other right, or contain any other information, content and/or material of any kind or nature; (b) represents and warrants that all elements contained in the giveaway entry (i) is original to the participant or fully cleared for use as contemplated herein, (ii) does and will not, in any way, violate or breach any of the terms of any other agreement the participant may be a party to, (iii) does not contain libelous, tortuous, or the publication or sale of which will violate any federal or state statute or regulation, (iv) is not obscene or in any other manner unlawful, and (v) shall not require GD Express Sdn Bhd to pay or incur any sums to any person or entity as a result of GD Express Sdn Bhd use or exploitation of the same.
9. Representatives of GD Express Sdn Bhd will select the entries with the steps performed as winners randomly.
10. GD Express Sdn Bhd’s decision is final and binding. No correspondence will be entertained about GD Express Sdn Bhd’s decision.
11. The winner may be required to participate in public relations events tied to GDEX Anak-Anak Malaysia Giveaway to generate press coverage of the giveaway. This may include, but not be limited to, quotes given for inclusion in press releases, interviews, etc.
12. GD Express Sdn Bhd reserves the right to disqualify all entries that do not meet the rules and regulations of GDEX Anak-Anak Malaysia Giveaway. These include entries submitted with invalid false, or incorrect information and profanity.

G. Liabilities

1. GD Express Sdn Bhd shall not be liable for any damage, loss, injury, or disappointment suffered by any entrant entering the giveaway or as a result of entering GDEX Anak-Anak Malaysia Giveaway or accepting any prize.
2. GD Express Sdn Bhd is not responsible for any safe custody, return, non-delivery or missing of entries, late, misdirected, problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet telephone lines or at any website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in GDEX Anak-Anak Malaysia Giveaway.
3. By entering GDEX Anak-Anak Malaysia Giveaway or accepting the prizes, entrants agree that no claim relating to such losses or injuries (including special, indirect, and consequential losses shall be asserted against GD Express Sdn Bhd, its parent companies, affiliates, directors, officers employees, merchants, partners, or agents from any and all losses, damages, rights, claims, and actions of any kind resulting from GDEX Anak-Anak Malaysia Giveaway and acceptance of any prize, including without limitation, personal injuries, death, and property damage.
4. All taxes on the prizes are the sole responsibility of the winners, who shall be responsible for completing any applicable forms required by a taxing authority. The winners hereby agree and accept that by winning GDEX Anak-Anak Malaysia Giveaway, the winners may incur taxes and other levies including but not limited to any prize tax or income tax etc. The winner hereby unconditionally accepts to bear any such tax or other levy.

H. Privacy and Data Protection

1. By providing the personal information upon the submission of entries, the entrants consent and are agreeable to the usage of their personal information by GD Express Sdn Bhd, including but not limited to names and images, in accordance with GD Express Sdn Bhd’s Privacy Policy.
2. In respect of any third party’s personal information as disclosed by entrants in his/she submissions to GD Express Sdn Bhd, entrant hereby warrants that he/she has the right to do so, and he/she has obtained the consent from such third party to disclose such personal information.
3. Entrant shall be responsible for ensuring that such disclosures are in compliance with the provisions of Malaysia Personal Data Protection Act 2010.
4. Entrants may notify of any updates, amendments, and corrections to previously collected information via Facebook page and the website.

I. General Conditions

1. By submitting GDEX Anak-Anak Malaysia Giveaway entry(ies), each entrant thereby
   represents and warrants that all elements contained in the submitted giveaway entry is original, previous unpublished, and do not contain any third-party copyrighted material, does not and will not, in any way, violate or breach any of the terms of any other agreement which the participant may be a party thereto, does not contain libellous, tortuous, or the publication or sale of which will violate any federal or state statute or regulation; and is not obscene or in any other manner unlawful.
2. The entrant should be able to provide on request all clearances, permissions and releases for the submission, including releases from all persons appearing in the photographs, and release from anyone who assisted in the creation of the photograph (in the event a submitting entrant cannot provide all required releases, GD Express Sdn Bhd reserves the right, in the GD Express Sdn Bhd’s sole discretion, to disqualify the applicable submission, or seek to secure the releases and clearances for GD Express Sdn Bhd’s benefit, or allow the applicable submission to remain in GDEX Anak-Anak Malaysia Giveaway.
3. The entrant shall not require GD Express Sdn Bhd to pay or incur any sums to any person or entity as a result of GD Express Sdn Bhd’s use or exploitation of the same.
4. Representatives of GD Express Sdn Bhd will select entries that are deemed the most relevant by GD Express Sdn Bhd as the winner(s).
5. All GD Express Sdn Bhd’s decisions are final and binding. No appeal or correspondence will be entertained into.
6. The winners may be required to participate in public relations events which are related to the giveaway to generate press coverage of GDEX Anak-Anak Malaysia Giveaway. This may include, but not be limited to, quotes given for inclusion in press releases, interviews, etc.
7. GD Express Sdn Bhd reserves the right to disqualify any invalid entry that does not meet the rules and regulations of GDEX Anak-Anak Malaysia Giveaway. These include any entry which is submitted with false, misrepresentation, or incorrect information.
8. GD Express Sdn Bhd reserves the right to add, delete, vary, or amend any of these terms and conditions at any time without prior notification. Any amendments or updates will be updated within these Terms & Conditions.
9. GDEX Anak-Anak Malaysia Giveaway is in no way sponsored, endorsed, administered, or associated with Facebook or Instagram. GDEX Anak-Anak Malaysia Giveaway is governed by the law of Malaysia.
10. GD Express Sdn Bhd will not be held responsible from any liabilities should the participant fail to comply with the terms.
